Spring Time Greetings from Hilton Head. It was wonderful to see all of you at the annual HOA Meeting which took place on Saturday, March 7, 2009. We hope that all who were able to attend the annual HOA Social on Friday, March 6, 2009 had a great time. Below is a summary of the weekend's events for you who may not have been able to attend.

The Election :

The annual election of the Board of Directors was held. Those elected, in order of finish, are as follows:

1. Arlene Smith, 2. Frank Desiano, 3. Julie Pinkham, 4. Patricia Hufenbecher. The Board then held a meeting to elect its officers. The results of that election are as follows:

*** * Shortly after the election it came to the attention of the Board of Directors that Patricia Hufenbecker was in fact renting the unit she lives in and is not the owner of record. Unfortunately this does not comply with the The Spa on Port Royal Sounds' Master Deed requirements for a Board of Directors position. Patricia submitted her resignation to the Board President on 4/9/09.

This opening has been filled by Mr. Bob Lynch who was next on the ballot for a Board of Directors position during the March 7th election. ****


Painting of the SPA:

We hope to be painting our buildings some time in the fall. During the preparation and paint processes certain areas at the SPA will become identified as no parking areas. so we need your cooperation If you have a special need during these working times please notify the office in writing of the special need and we will work with you to minimize the inconvenience.

Solar Heated Pool & Hot Tub:

The permits have been obtained, solar panels installed, the system has been inspected by the DEAC and approved. The Spa On Port Royal Sound now has the only approved commercial application of a solar heated hot tub in the state of South Carolina. I can tell you this was not an easy feat to accomplish, but in a short time this system will pay for itself and as long as the Sun and Fun stays in South Carolina the SPA on Port Royal Sound will heat it's indoor pool and Spa with solar heated hot water. We will evaluate this systems performance and determine what else we can turn into a green performing solar powered application on our site. The SPA's objective will be to reduce our operating costs if the pay back for a solar powered application is fast and makes good business sense. Hot Water Heaters

Hot Water Heaters that are older then 10 years old should be replaced. All of the original units installed were 120 gallon Rheem hot water heaters are 20+ years old and must be replaced now. They are bursting at the bottom and causing several thousands of dollars of damage to Villas. Should your hot water heater leak and cause damage to your neighbors Villa, you as owner will be responsible for all of the water damage to your neighbors villa. It will be far cheaper to replace your water heater with one of the Marathon Water heaters with a life time guarantee. Here is something to think about: It's easy to forget that there are neighbors close by who can hear slamming doors, loud conversation, high volume on television and stereos, honking horns and heavy feet. Please accept this gentle reminder to live as quietly as you can. Everyone sincerely appreciates your effort. Thank you.

Security Deposits

For those who rent their units long term (longer than 60 days), please remember that your tenants must pay a $125.00 per person (adults) security deposit. They must also pay a $125.00 vehicle deposit, which includes 2 vehicle IDs and up to 4 Spa Photo IDs. If there are no fines assessed during their tenancy they will receive their occupancy deposits and they will receive $25.00 of their vehicle fees when they move out.

Reminder:

There can be no more than two vehicles per unit. There can be no more than six people (including children) in a two bedroom unit and no more than four people (including children) in a one bedroom unit.

Important Reminder:

If you rent a storage unit remember that The Spa is not responsible for articles that may be lost or stolen. Be careful with your keys and talk to us about having your locks changed when renting a unit.

Please remember that all locks must be keyed to a Spa master key. This is imperative because in the event of a major leak or other problem we may have to enter your unit in order to make repairs or to turn your water off. If we can not access your unit we will have to break in which will cause damage (which will be repaired at owner's expense). In the case of catastrophic water leak 3 minutes could be the difference between minor damage and the total flooding of three or four units. If you do not have your unit or your storage unit keyed to our master contact the HOA Office and we will give you the information that you need in order to comply.

Security:

Please remember that the Security Office can only issue passes for more than one day when the HOA Office is closed. If you have a guest who will be staying longer than twenty four hours please send them to the HOA Office in order to get a guest pass. Business hours are between 8:00am and 12:00pm and between 1:00pm and 4:00pm Monday through Friday. You may also telephone the HOA Office and we will make sure your guests have a pass waiting for them when they arrive. We will need their name, your unit number, the date that they will be arriving, and their date of departure. You can also email us with requests for guest passes at hoaspa@earthlink.net. Keep in mind that your email must be received during normal business hours. (8am to 4pm)

Please remember to have your guest park in visitor parking.

Bicycle Rules:

Because of the overcrowded situation in our bicycle storage areas we have implemented a program of bicycle registration. We will be issuing a sticker, at no charge to all bicycle owners. In this way we will be able to determine whether a stored bicycle is someone's property or just something that was left behind by tenants or owners who have already moved out, Thanks for your cooperation.

Lucille DiRuocco from Mt Kisco, NY won the prize at The Spa’s Real Estate Open House in February.

Pets at The Spa

At the recent Homeowners Meeting, some individuals expressed an interest in having pets at The Spa.

Currently, the Master Deed states, “No animals or pets of any kind shall be kept in any Apartment or any property of the Regime, except as required or permitted by law (such as guide dogs, etc.).” A change to the Master Deed requires the approval of 67% of the homeowners.

As a first step, we are conducting the following survey:

It was a pleasure visiting with so many of you at out Friday night get together and at the Annual Meeting. Thank you for a great turnout and participation.

Last year, we hired a new General Manager, Michael J. Vassallo. He hit the ground running and has made tremendous progress in the areas of landscaping, security, a villa maintenance database, facility renovation and internal records management. Michael has agreed to a new, two year employment commitment. We look forward to more and greater accomplishments from him.

This year, the Board of Directors, Michael and the Spa Staff will be focused on the painting of the buildings, additional facility renovation and the general appearance of the Spa. We feel that these efforts, in conjunction with the beach renourishment and luxury home construction on Beach City Road, will help raise the value of our villas.

" Greetings from Hilton Head. We hope that all of you are holding to your New Year's resolutions. Here is a quick update from The Spa.

" The Annual Meeting of the Homeowners is scheduled for March 1, 2008. We will be electing four Board Members. If you would like to run please return your application by January 31, 2008. Once we have a list of candidates we will be sending you ballots and instructions for voting. You will receive your packets during the first week of February.

" We are happy to announce that we have started renovations on the large outdoor pool. These renovations will be completed in the next few weeks depending upon the weather. We are re-plastering, installing new tile and new railings. After the pool is completed the decking will be completely re-finished When completed the pool will look brand new.

" Board President Cynthia Macalister has teamed up with two veterans Hilton Head Realtors, Linda Klatt and Barbara Verhey to host the Second Annual Open House at The Spa on February 17, 2008 from 1 to 4 pm. Last year's event brought in about 100 interested buyers and several sales resulted. This year they want to expand it by having a "Real Estate Fair" in the Meeting Room. So that in addition to looking at property, buyers will be able to meet with Mortgage Bankers, Cleaning Companies, Rental Agents, etc. Everyone is welcome to meet with these companies as well. Cynthia Macalister and Linda Klatt are sweetening the pot by putting up a prize, worth $800.00, to be won in a drawing at the end of the day. " Hello from the shores of Port Royal Sound. We hope that all of you are doing well. This is the last Soundings of 2007 and we wish all of you a very happy holiday season and a joyous, healthy, and prosperous 2008. By now all of you should have received your annual homeowners' packet. If you have not please contact the HOA office. The annual social will be held on February 29, 2008 and the annual Homeowners' Meeting is on March 1. We hope to see all of you there.

" As some of you may already know The Spa Community has lost one of its shining stars. Board Member Vern Clarke passed away on October 31st. He was an owner at The Spa for many years and was on the Board for many years as well. He was instrumental in moving the beach replenishment project forward and in many of the projects and procedures that have shaped The Spa for the past few years. To his family we offer our most sincere condolences. He will be missed by our entire community. His passing is a terrible loss but his legacy is his spirit which will always be present on the beach and in the community that he loved so much.

A Letter From HOA President, Cynthia Macaliaster

I am pleased to announce that the Board of Directors has unanimously voted to offer Michael J. Vassallo a new two year contract. Michael and his wife Kate have recently purchased a new home in Sun City and we are happy they decided to make the Low Country their new home. Michael has made a positive difference at The Spa and we're looking forward to having him as our General Manager for at least two more years.

As 2007 comes to a close, there are several new developments that I'd like to share with all of you.

Lynne Wilken has resigned from the Board of Directors because of health issues. She was a very active Board Member and she will be missed. Doug Embry is replacing Lynne as Treasurer. He has a lot of experience with Spa budgets and finances and I know he'll do a professional job. Board Secretary Sam Einfeldt will be helping me with Spa landscaping. We have a number of great ideas to continue refreshing our grounds.

As an Island resident I regularly attend Hilton Head Town Council meetings. On December 4, 2007 the length of the Hilton Head Airport runway was a hot topic of discussion. It will be some time before a decision is made about keeping the runway at 4300 ft. or lengthening it to allow larger planes. I will keep you informed.

Many of you have asked me questions about renting your units to vacationers. As you may know I put together a directory of Spa owners who want to do short term rentals. If you would like to join us or just get more information please call me at (843) 368-1813.

We will be planting a memorial garden to honor past Board members Vern Clarke and Bruce Saunders. The dedication will take place on March 1, 2008.

I'd like to include a homeowner's "tip" as a regular feature in the Soundings. The December tip is: To make your kitchen and bathroom faucets sparkle like new, coat them with automotive wax. Turtle Wax works well and is low cost. The wax also works well on the stainless steel in the bath tubs.

Lastly, I'd like to wish each of you a happy and healthy holiday season. I look forward to seeing you in March at our annual meeting.

Hello from Hilton Head Island. We had a wonderful summer here at The Spa. Despite the record heat the grounds look great. Our beach has held up as well despite many days of northeast winds and exceptionally high tides. Board of Directors member Vern Clarke has been in contact with our local authorities and they have informed him that they will be planting grass this fall in an attempt to build a dune line which will help the sand stay in place under some of the harsh weather conditions that we encounter on the island.

We have had many violent thunderstorms in the past couple of months. Many of you have had your electronic equipment damaged by power surges which result from these intense electrical storms. Please remember that unplugging your TV, Computer or other electronic from the wall outlet is not enough to protect against damage. You must unplug the cable or satellite dish line from the wall in order to be sure that there is no damage. Cable lines are copper and can carry enough electrical charge to destroy a television set or a computer. If you have a telephone line plugged into your computer you must unplug it during a storm in order to protect your computer. There are also surge protectors which protect electrical, phone and cable lines. They are available at retail outlets that handle electronic equipment or office supplies.

Please remember that all contractors are required to provide the HOA office with a Certificate of Insurance which includes proof of both General Liability and Workers Compensation coverage. The contractor also must purchase either a yearly sticker ($25.00 July 1 through June 30) or a daily pass ($3.00 per day) at the HOA office prior to beginning any work. Don’t forget all renovations must be approved by the General Manager.

Those of you who rent your units on a long term basis please don’t forget to have your tenants register with the HOA Office.

We have welcomed a new Captain of Security. His name is Matt Ayers and he has replaced Cynthia Sartin who had to leave due to health concerns. He will be working closely with Board of Directors Secretary Sam Einfeldt to improve security at The Spa. Sam has been in constant contact with our security contractor Securitas so that we can improve the efficiency of our force. For the past seven months he has worked closely with our General Manager to examine all of our procedures in order to improve our ability to serve the residents and owners of our community. and click on the link to email the General Manager. We cannot improve security if we can’t identify the everyday problems that our owners and residents face.

Our Board of Directors Treasurer Lynne Wilken has been busy with our maintenance staff spreading mulch and re-doing the beds in Phase II. Those of us who are here every day have really noticed a change. Board Member Frank Desiano has finished writing a comprehensive set of rules and regulations for The Spa. You can find them by going to our website and clicking on “Rules”. Frank is also chairing a Board Committee consisting of himself, Board President Cynthia Macalister, Vice President Alec Ross and Member at Large Vern Clarke which will institute a fine schedule for all rules violations.

We would like to thank Board Member Doug Embry for constructing and helping to install the new drains at the foot of the pier near the water hookup.

" Hello from Hilton Head Island. We all hope that you are enjoying the summer of '07. Things are going very well at The Spa despite the record heat we have been experiencing this year.

" Here are a few reminders and updates:

The fee for the meeting room has been increased to $100.00 along with a $100.00 security deposit which is refundable if the room is cleaned and all decorations are removed. Those interested should call Naryi at the HOA office to get all of the details.

All contractors are required to provide the HOA office with a Certificate of Insurance which includes proof of both General Liability and Workers Compensation. The contractor also must purchase either a yearly sticker ($25.00 July 1 through June 30) or a daily pass ($3.00 per day) at the HOA office prior to beginning any work. Don't forget all renovations must be approved by the General Manager.

Please don't forget to bring the old sticker into the office when renewing all parking permits.

We have made wholesale changes to our security force. The Spa has been in constant contact with Securitas (our security provider) in the hopes of improving the quality of our personnel. General Manager Michael Vassallo has made it perfectly clear that we will not tolerate officers who do not enforce the rules and regulations of this property. We ask that all homeowners call security if they are being bothered by noise or bad behavior from someone in another villa or by someone in the common areas. We cannot improve conditions at The Spa if we do not know what is happening. Please do not sit there and suffer. Call security. The first thing that Michael does every morning is read the previous night's security reports. If no one calls and no one reports a problem or violation it is nearly impossible for the HOA staff to stop the annoying or disturbing behavior. We have collected nearly $1700.00 in fines to date in 2007. We will take action if you identify a problem.

Patty Desiano has agreed to become our new webmaster. As many of you know the old web site was never really finished and many of the links did not work. The new design will have links to rules and regulations, email for the HOA Office, the Board of Directors and the General Manager. Also we will be able to post messages about upcoming events along with the latest issue of Soundings. The new address is http://www.thespaonportroyalsound.net.

Don't forget to send us your email address. We can save a substantial amount of postage if we can communicate with you via email or via the new web site. Just drop us a note at hoaspa@earthlink.net and we will add your email address to our files.

Long time security Captain Cynthia Sartin has been out of action for the past few weeks recovering from surgery. We all send our best wishes for a speedy recovery.

" Greetings from the shore of Port Royal Sound. We hope that everyone is enjoying their summer.

" Here are the highlights of the Board of Directors meeting which took place on June 8, 2007:

For those of you who rent your villas on a long term basis (longer than 60 days) there has been a change in the policy regarding tenant parking passes. In the past the Spa has charged a $100.00 fully refundable deposit on all long term tenant parking stickers. Beginning on July 1, 2007 only $50.00 of that deposit will be refundable. The remaining amount will be placed into a capital improvement account which will be used for parking lot repairs and eventual repaving.

Beginning on July 1, 2007 all contractors who work at the spa will be required to submit a Certificate of Insurance to the HOA office and be required to purchase a contractor sticker which will be displayed on their vehicle. The price of a sticker is $25.00 per year (July 1, 2007 to July 1, 2008) or $3.00 per day. This fee will cover administrative expenses but more importantly the Certificate of Insurance that is provided will limit the liability of The Spa in the event of accidental property damage or worker injury.

" REMEMBER, before you do any kind of CONSTRUCTION OR ANY ALTERATIONS to your unit and before you CUT DOWN, DIG UP or PLANT, anything on the premises, you MUST GET APPROVAL from the General Manager, Board of Directors and in some cases from the City of Hilton Head. Contacting the Manager before you proceed will save you a lot of problems and un-necessary expense.

" It is the owner's responsibility for the conduct of their tenants/guests. Currently the Spa requires a $l00.00 deposit be paid for each adult tenant residing in the unit for a term longer than 60 days. If there are any fines or damages owed to the Spa at the time your tenant/guest departs, then they are deducted from his/ her deposit. If the tenant/guest fails to cover the full amount due then the Homeowner is responsible for the balance owed. This is to protect the owner from any fines that may be assessed against that tenant. If left unpaid, it will eventually result in a lien placed upon your property. So, make sure your tenants and guests know the rules and tell your rental agent that you will not tolerate any unregistered guests or tenants on Spa property. A copy of the rules and regulations is available from the HOA office in both English and in Spanish.

" Just a reminder that homeowners are urged to purchase a condominium unit owners' policy, commonly referred to as HO6. This provides coverage for your personal contents, general liability, and loss of improvements and betterments made to the unit
